QUESTION PAPER FOR WRITTEN EXAMINATION FOR ENROLLMENT AS ADVOCATE (February 26, 2010)

GROUP-A
১. নিম্নলিখিত যে কোন ৪টি ব্যাখ্যা করুন- [Explain any four of the following]
ক) আইনানুগ প্রতিনিধি; [Legal representative]
খ) রিসিভার; [Receiver]
গ) মোকদ্দমার কারণ; [Cause of action]
ঘ) আরজি খারিজ [Rejection of plaint]
ঙ) প্লিডিংস; [Pleadings]
চ) স্থানীয় পরিদর্শন।[Local inspection]
২. উদাহরণসহ রেস জুডিকাটার বিধানাবলী আলোচনা করুন। [Discuss the provisions of res judicata with an illustration]
৩. প্লিডিংস সংশোধন বলতে আপনি কি বুঝেন? প্লিডিংস সংশোধনের ক্ষেত্রে নিয়ামক শর্তাবলী কি কি? বিচারক আদালত কর্তৃক রায় ঘোষণার পর কি প্লিডিংস সংশোধন করা যায়। [ What do you mean by amendment of pleadings? What are the conditions that regulate the grant of amendment of pleadings? Can there be an amen dment of pleadings after the judgment is pronounced by the trial Court?]
GROUP-B
৪. কোন ক্ষেত্রে নির্দিষ্ট প্রতিকার আইনের ৯ ধারায় মোকদ্দমা রুজু করা যায়। ঐ ধারায় মোকদ্দমা করবার সুবিধাসমূহ কি কি? কার বিরুদ্ধে এরুপ মামলা করা যায় না? [When can a suit be filed under Section 9 of the Specific Relief Act? What are the advantages of filing a suit under this Section? Against whom such a suit can not be filed?]
৫. দলিল বাতিল বলতে কি বুঝায়? কি কি কারণে এবং কে এরূপ প্রতিকার পেতে পারেন? বিরোধীয় দলিলে পক্ষ আছেন এমন কোন ব্যক্তি কি শুধুমাত্র দলিলটি জাল এবং তার উপর বাধ্যকর নয় মর্মে ঘোষণামূলক ডিক্রীর প্রার্থনায় মামলা দায়ের করতে পারেন? [What is meant by cancellation of an instrument? Who can seek such a relief and on what grounds? Can a party to a disputed document maintain a suit for a mere declaration that the document in question is a forged one and it is not binding upon him?]
৬. চুক্তি প্রবল বলতে কি বুঝায়? কোন কোন অবস্থায় আদালত চুক্তি প্রবলের ডিক্রী প্রদান করবেন না? [ What is meant by specific performance of contract? In which situations will the Court refuse to pass a decree for specific performance of contract?]
GROUP-C
৭. দণ্ডবিধির ৩০২ ধারায় অভিযুক্ত আসামীর জন্য একটি জামিনের দরখাস্ত মুসাবিদা করুন। আপনার ইচ্ছামত আদালত ও পক্ষগণের নাম ব্যবহার করুন। দরখাস্তের কজ টাইটেলে আইনের সংশ্লিষ্ট ধারা ও উল্লেখ করুন। [Draft an application for bail for a person accused of an offence under Section 302 of the Penal Code. Choose as you like the names of the Court and the parties. Mention the relevant provision of law in the cause title of the application.]
৮. অভিযোগ থেকে অব্যহতি এবং বেকসুর খালাসের মধ্যে পার্থক্য নির্ণয় করুন। ফৌজদারী কার্যবিধির ২৪১ এ ধারার বিধানমতে আসামীকে অব্যহতি প্রদানের বিষয়ে বিচারিক হাকিম কি কি বিষয় বিবেচনা করেন? চূড়ান্ত বিচারের পর বেকসুর খালাসপ্রাপ্ত আসামীকে কি পুনরায় একই অপরাধের অভিযোগে বিচার করা যায়? [Distinguish between discharge and acquittal. What considerations weigh in mind of the Judicial Magistrate in discharging an accused under Section 241A of the Code of Criminal Procedure? Can an accused be tried by the Court for the same offence in which he was earlier acquitted after a regular trial?]
৯. তদন্ত বলতে কি বুঝায়? ফৌজদারী কার্যবিধীর বিধান অনুযায়ী মামলা তদন্ত সংক্রান্ত পুলিশের ক্ষমতা আলোচনা করুন। [What is meant by investigation? Discuss the power of the police in respect of investigation of a case as per the provisions of the Code of Criminal Procedure.]
GROUP-D
১০. দণ্ডবিধির ২৯৯ ও ৩০০ ধারাসমূহে সংজ্ঞায়িত অপরাধসমূহের মধ্যে প্রধান পার্থক্যগুলো আলোচনা কর। [Discuss the essential differences between the offences defined in Sections 299 and 300 of the Penal Code.]
১১. উদাহরণসহ যে কোন ৪টি ব্যাখ্যা করুন- [Explain and illustrate any i.of the following]
ক) অপরাধ সংঘটনে সহযোগিতা, [Abetment]
খ) আত্মরক্ষার অধিকার, [Right of private defence]
গ) চুরি,[Theft]
ঘ) সাধারণ ইচ্ছা,[Common intention]
ঙ) বেআইনী জনতা,[Unlawful assembly]
চ) ডাকাতি।[Dacoity.]
১২. দণ্ডবিধির সংশ্লিষ্ট ধারাসমূহ উল্লেখপূর্বক পৃথক উদাহরণসহ প্রতারণা ও অপরাধমূলক বিশ্বাসভঙ্গ বিশ্লেষণ করুন।[Analyse the ingredients of cheating and criminal breach of trust’ mentioning the relevant sections of the Penal Code and giving separate examples.]
GROUP-E
১৩. সাক্ষ্য আইনের সংশ্লিষ্ট বিধানাবলীর আলোকে উদাহরণসহ doctrine of estoppel ব্যাখ্যা করুন। কোন আইনের বিরুদ্ধে কি estoppel হতে পারে? [ Explain and illustrate the doctrine of estoppel with reference to the relevant Act. Can there be any estoppel against a statute?]
১৪. কোন ধরনের মোকদ্দমায় তামাদি আইনের ৫ ধারা প্রযোজ্য হবে? আদালত কি ঐ আইনের ৫ ধারা মোতাবেক দায়েরকৃত কোন দরখাস্ত মঞ্জুর করতে বাধ্য?
[In what kind of legal proceedings will section 5 of the Limitation Act be applic able? Is a Court bound to grant any application filed under section 5 of that Act?]
১৫. ফৌজদারী কার্যবিধির ১৬৪ ধারা অনুযায়ী একজন আসামীর স্বীকারোক্তি রেকর্ড করার ক্ষেত্রে কি কি আবশ্যকীয় শর্তাবলী পালন করতে হয়? পুলিশের নিকট প্রদত্ত স্বীকারোক্তি সাক্ষ্য আইনের অধীনে কতটুকু গ্রহণযোগ্য? [What are the essential requirements to be complied with in recording the confession of an accused under section 164 of the Code of Criminal Procedure? How for is a confession make to the police admissible under the Evidence Act?]

১৬. বাংলাদেশ বার কাউন্সিলের গঠন ও কার্যাবলী আলোচনা করুন। [Discuss the composition and functions of the Bangladesh Bar Council.]
১৭. পেশাগত আচরন ও অসদাচারণ নীতিমালার আলোকে একজন এডভোকেটের আদালত, মক্কেলসহ আইনজীবী এবং জনসাধারণের প্রতি কর্তব্য ও দায়িত্বের বিবরণ দাও। [Enumerate the duties and responsibilities of an Advocate to the Court, to his client, to the fellow advocates and to the members of the public in the light of the Canons of Professional Conduct and Etiquette.]
১৮. The Bangladesh Legal Practitioners and Bar Council Order and Rules 1972 -এর বিধান অনুযায়ী ট্রাইব্যুনালের গঠন ও কার্যাবলী আলোচনা করুন। উক্ত ট্রাইব্যুনাল আইনজীবীদের পেশাগত অসদাচরণের জন্য কি কি ধরনের শাস্তি প্রদান করতে পারে? [Discuss the constitution and functions of the Tribunal under the Bangladesh Legal Practitioners and Bar Council Order and Rules, 1972. What types of punishments can the Tribunal impose on Advocates for professional misconduct?]
