QUESTION PAPER FOR WRITTEN EXAMINATION FOR ENROLLMENT AS ADVOCATE (July 31, 2015)

[Answer seven questions taking two from Group A and one from each other Group]

GROUP- A

১. প্লিডিংস সংশোধন বলতে আপনি কি বোঝেন? প্লিডিংস সংশোধনের ক্ষেত্রে নিয়ামক শর্তাবলী কি কি? বিচারিক আদালত কর্তৃক রায় ঘোষণার পর কি প্লিডিংস কি সংশোধন করা যায়? [What do you mean by amendment of pleadings? What are the conditions that regulate the grant of amendment of pleadings? Can there be an pleadings after the judgment is pronounced by the trial Court?]

২. ‘এখতিয়ার এবং দেওয়ানি প্রকৃতির মোকদ্দমা’ বলতে আপনি কি বোঝেন? কোন কোন ক্ষেত্রে মামলার আরজি খারিজ করা যায়? আইনের বিধান উল্লেখপূর্বক আরজি খারিজের দরখাস্ত মুসাবিদা করুন।[What do you mean by Jurisdiction and Suits of a civil nature”? What are the grounds under which a plaint can be rejected? Draft a petition for rejection of plaint mentioning the relevant provision of law.

৩. দলিল বাতিল বলতে কি বোঝায়? কি কি কারণে এবং কে এরূপ প্রতিকার পেতে পারেন? বিরোধীয় দলিলে পক্ষ আছেন এমন কোনো ব্যক্তি কি শুধুমাত্র দলিলটি জাল এবং তার ওপর বাধ্যকর নয় মর্মে ঘোষণামূলক ডিক্রির প্রার্থনায় মামলা দায়ের করতে পারেন? [What is meant by cancellation of an instrument? Who can seek such a relief and on What grounds? Can a party to a disputed document maintain a suit for a mere declaration that the document in question is a forged one and it is not binding upon him?]

GROUP – B
৪. অভিযােগ থেকে অব্যাহতি এবং বেকসুর খালাসের মধ্যে পার্থক্য নির্ণয় করুন। ফৌজদারী কার্যবিধির ২৪১এ ধারার বিধান মতে আসামিকে অব্যাহতি প্রদানের বিষয়ে বিচারিক হাকিন কি কি বিষয় বিবেচনা করেন? চুড়ান্ত বিচারের পর বেকসুর খালাসপ্রাপ্ত আসামিকে কি পুনরায় একই অপরাধের অভিযোগে বিচার করা যায়? [Distinguish between discharge and acquittal. What consideration weigh in the mind of the Judicial Magistrate in discharging an accused under Section 241A of the Code of Criminal Procedure? Can an accused be tried by the Court for the same offence in which he was earlier he was earlier acquitted after a regular trial?]

৫. উদাহরণসহ সংশ্লিষ্ট আইন উল্লেখপূর্বক বাংলাদেশ সুপ্রীম কোর্টের হাইকোর্ট বিভাগের অন্তর্নিহিত ক্ষমতা সম্পর্কে  আলোকপাত করুন। [Throw light on the inherent powers of the High Court Division of the Bangladesh Supreme Court with reference to the relevant provision of law along with an example,]

GROUP- C

৬. দন্ডবিধি ২৯৯ ও ৩০০ ধারাসমূহে সংজ্ঞায়িত অপরাধসমূহের মধ্যে প্রধান পার্থক্যগুলাে উদাহরণসহ আলােচনা করুন।[Discuss the essential differences between the offences defined in Sections 299 and 300 of the Penal Code with examples.]

৭. দণ্ডবিধির সংশিষ্ট ধারাসমূহ উল্লেখপূর্বক পৃথক উদাহরণসমূহ ‘প্রতারণা’ এবং ‘অপরাধমূলক বিশ্বাসভঙ্গ’ বিশ্লেষণ করুন।[Analyse the ingredients of cheating and criminal breach of trust’ mentioning the relevant sections of the Penal Code and giving separate examples.]

GROUP – D

৮. সাক্ষ্য আইনের সংশিষ্ট বিধানাবলীর আলােকে উদাহরণসহ doctrine of estoppel ব্যাখ্যা করুন। কোনো আইনের বিরুদ্ধে কি estoppel হতে পারে? [Explain and illustrate the doctrine of estoppel with reference of the relevant provisions of the Evidence Act. Can there be any estoppel against a statute?]

৯. সাক্ষ্য আইন অনুযায়ী facts in issue এবং relevant facts ব্যাখ্যা করুন। ইঙ্গিতবাহী প্রশ্ন বলতে আপনি কি বোঝেন? উদাহরণ দিন। সাক্ষীর জেরা ও জবানবন্দিতে কি ইঙ্গিতবাহী প্রশ্ন করা যায়? [Explain facts in issue and relevant facts with reference to the Evidence Act What do you mean by a leading question? Give an example.Can a leading question be asked in examination-in-chief and cross-examination of a witness?]

১০. কোন ধরনের মােকদ্দমায় তামাদী আইনের ৫ ধারা প্রযােজ্য হবে? আদালত কি ঐ আইনের ৫ ধারা মােতাবেক দায়েরকৃত কোন দরখাস্ত মঞ্জুর করতে বাধ্য? [In what kind of legal proceedings will Section 5 of the Limitation Act be applied cable? Is a Court bound to grant any application filed under Section 5 of that Act?]

১১. ১৯০৮ সনের তামাদি আইন পাসের উদ্দেশ্য কী? ‘আইনগত অক্ষমতা’ বলতে কি বোঝেন? [What is the purpose behind enactment of the Limitation Act, 1908? What do you mean by ‘legal disability’?]

১২. আইনজীবীদের পেশাগত দক্ষতা, সম্মান ও শৃঙ্খলা রক্ষার ক্ষেত্রে বাংলাদেশ বার কাউন্সিল কতটুকু সফলকাম হয়েছে? আপনার উত্তরের পােষকতায় কারণসমূহ বর্ণনা করুন।[How far has the Bangladesh Bar Council succeeded in upholding the professional efficiency, dignity and discipline of lawyers? Give reasons in support of your answer.]

১৩. সংশ্লিষ্ট আইন মােতাবেক একজন আইনজীবী হিসেবে আপনি কিভাবে গােপনীয়তা, স্বচ্ছতা এবং দায়বদ্ধতা রক্ষা করবেন? [How will you maintain confidentiality and accountability as a lawyer as per the relevant law?]
